Foreign Exchange Management (Transfer or Issue of any
Foreign Security) (Third Amendment) Regulations, 2013

In exercise of the powers conferred by clause (a) of sub-section (3) of Section 6 and sub-section (2) of Section 47 of the Foreign Exchang0.e Management Act, 1999 (42 of 1999), the Reserve Bank hereby makes the following amendments in the Foreign Exchange Management (Transfer or Issue of Any Foreign Security) Regulations 2004 (Notification No. FEMA.120/RB-2004 dated July 7, 2004), as amended from time to time, (hereinafter called the Principal Regulations or the Notification) namely:-

1. Short Title & Commencement:-

(i) These Regulations shall be called the Foreign Exchange Management (Transfer or Issue of Any Foreign Security) (Third Amendment) Regulations, 2013.

(ii) They shall come into force from the date of publication in Official Gazette.

2. Insertion of new Regulation in Part I:-

In Part I, after Regulation 6C, the following Regulation shall be inserted:

“6D General Permission for Acquiring Equity of SWIFT

A banking company in India, being licensed by the Reserve Bank of India under the provisions of the Banking Regulation Act, 1949, may acquire the shares of Society for Worldwide Interbank Financial Telecommunication (SWIFT), Belgium as per the by-laws of SWIFT, provided that such banking company has been permitted by the Reserve Bank for admission to the ‘SWIFT User’s Group in India’ as member.”
