Pre-bid meeting for the captioned Project was held on March 01, 2023, 11:00 AM in Multipurpose Hall, RBI Jammu as per the schedule indicated in Notice Inviting Tender (NIT) on February 02, 2023. The list of participants is indicated below:

3. Shri S.G. Maulik, Deputy General Manager, Estate welcomed the participants to the meeting and invited queries, if any, from the prospective bidders regarding the captioned tender. The details of queries raised by the Contractors & suppliers and clarifications / comments of the Bank are tabulated below:

1 Request for reducing Performance Bank Guarantee (PBG) to 3% as per Ministry of Finance Memorandum No. F.9/4/2020-PPD No change in particular tender condition.
2 Price adjustment considers 70% variation on account of materials and 30% for labor. As the contract period is 40 months, contractor has requested further segregation of variation of cement, steel and labor & other materials as per CPWD GCC clause 10C & 10CC No change in particular tender condition.
3 It is given that the price of ‘Basic Prices’ are ex-Godown and are inclusive of applicable taxes whereas in BOQ Section IX Basic Prices are exclusive of GST. Tender provisions are modified as under:

Clause SC 02 ix)/ Page no 133 modified to: ‘Wherever the ‘basic rate’ for the material is specified, the contractor shall furnish all the paid bills for Employer’s verification. The purchase rate shall be got approved from the Engineer-in-charge before purchasing. The adjustment in price shall be made only on measured quantity. No overhead and profit shall be considered on the cost difference. The basic prices are ex-Godown and are exclusive of all applicable taxes and duties levied by Government or any other statutory body and excluding transportation to site, loading, unloading, storing and handling etc. The rate quoted for the items shall include transportation to site, loading, unloading, storing, handling and all taxes etc.

Clause SC 18 ii) / Page No 139 and 140 modified to: ‘While quoting the rates, the Tenderer should base their item rates at “the Basic Prices” wherever specified. The said prices are ex-Godown and are exclusive of all applicable taxes and duties levied by Government or any other statutory body and excluding transportation to site, loading, unloading, storing and handling etc. The rate quoted for the items shall include transportation to site, loading, unloading, storing, handling and all taxes etc. (ex-Godown referred here will be dealer’s Godown or Rail head within the Municipal or city limits or the city where the work is being done).
4 In Clause 33 of Section V (Pg. 124) regarding Levy/Taxes payable by the contractor, it is mentioned that the bid shall not include the said labour cess in their price. Please clarify, if the amount of cess applicable increases during the contract, the liability of the extra cess (if any), will be borne by RBI or the contractor. The amount of labour cess payable if varies during the contract period, the difference in the amount will be borne by the Bank.
5 Existing Under Ground Services – It is discussed with the RBI during Pre-Bid meeting to clarify whether there are any existing underground services passing through the site plot. Please refer to clause No.12/ Page No 92 to 98 and item no 5.1/ Page No 174 of the Tender part I in this regard.
6 During the construction period, if there is any statutory change in the GST rate i.e if any hike in GST rate occurs. Then will the contractor be compensated for additional GST?

Since the construction period is 40 months. Hence our suggestion is that variation in all the statutory taxes should be compensated as per actuals to the contractor
Clause 34 (i) / Page No 124 and 125/ Tender part I modified to:

‘Any variation in taxes / cess / levies (increase or decrease) and introduction of any new taxes / cess / levies as per statutes with respect the tax / cess / levy as on last date of submission of tender will be adjusted (paid / recovered) from the bills of the contractor based on submission of documentary evidence’.
7 Request for submission of last date of tender to extend up to 1 week. Request for extending submission of tender by one week i.e. up to March 20, 2023 has been considered. Separate corrigendum will be uploaded on Banks’ website in this regard.
8 Query from supplier: The supplier requested to incorporate their make in Approved make of list in some of the items. With respect to the queries raised on Approved make of materials provided in the tender, it is clarified that ‘Equivalent make/ model of items specified in the tender if proposed by the contractor during execution of work, shall also be considered subject to compliance of the same to the technical specifications, other requirements mentioned in the tender and approval by the Bank’.

4. Bidders shall note that all the above clarifications provided by the Bank during the pre-bid meeting along with details indicated in the Tender document shall form part of the Tender/Contract.
