Minutes of the Pre-bid meeting cum Corrigendum - Annual Maintenance Contract for Housekeeping/ Cleaning & Sweeping at Main Office Building (MOB), Additional Office Building (AOB), Annex Buildings (MOB and AOB), Common & Peripheral Area and Sports Complex (AOB), Data Recovery Data Center (DRDC) and Residential Properties (BTOQ, TRSQ, ARSQ and ALSQ) of RBI Nagpur

The Prebid meeting for the captioned tender was held on July 13, 2022 at 11:30 Hrs through CISCO WebEx. The following staff members of RBI and firms/prospective tenderers were present during the pre-bid meeting:

2. The following queries/proposals were raised in the pre-bid meeting:

S. No Query/Proposal Clarifications furnished by the Bank
i. In view of the recently issued circular on Plastic Ban, kindly clarify on the type of garbage bag to be provided. Only 100% Oxo- biodegradable garbage bags are to be provided. The garbage bags provided should strictly meet the government guidelines issued from time-to-time.
ii. Is it compulsory for the successful tenderer to take Workmen Compensation and All Risk Insurance? Will the cost of these insurance policies be reimbursed to the contractor separately? Kindly refer clause 23 of “General Instructions to Tenderers’ and Special Conditions of the Contract” (Page No. 29). The successful tenderer shall compulsorily take “all risk policy" for the contract value and workmen compensation policy for the workers engaged in the work.

The cost of these insurance policies is necessarily to be included in the quoted profit in the financial bid. No reimbursement of the cost of these insurance policies will be made to the contractor.
iii. What all materials to be provided by the contractor should have GreenPro® certification? All the cleaning materials to be provided by the contractor, as indicated under clause 1 (7) of “Scope of Work and Schedule of Quantities” (Page No. 42), are necessarily to be certified with GreenPro® certification.
iv. Will the cost of Bonus and Leave Reserve Wages be reimbursed to the contractor separately? Kindly refer to clause 5 of “General Instructions to Tenderers’ and Special Conditions of the Contract” (Page No. 26). The cost of bonus payment to the contract workers, if applicable shall be borne by the contractor and no reimbursement for the same will be made by the Bank.

Further, in terms of Clause 1(1) of “Scope of Work and Schedule of Quantities” (Page No. 41), Weekly holiday must be given to all housekeeping staff (which should be strictly adhered to) as per Statutory Requirement without affecting services. While, leave must be given to the workers as per labour laws with an alternative arrangement, no extra payment in this regard will be considered other than rates quoted by the firm.

However, in terms of clause 27 (d) of “Terms & Conditions of Contract” (Page No. 58), labourers/workers if deployed on National Holidays shall be compensated appropriately by contractor and the invoice for charges/expenditure for the same is to be submitted separately for reimbursement along with the proof of remitting such compensation to the labourers.
v. What all materials are to be provided by the contractor and in what quantity? Kindly refer to the list of materials indicated in clause 1(7) (Page No. 42) of “Scope of Work and Schedule of Quantities” to be provided by the contractor at its own cost.

A few items are hereby included as an addition to the above-mentioned list under consumables like toilet paper rolls, paper towels, tissue paper etc.

However, it is reiterated that the said list is indicative and is not intended to be exhaustive.

To properly assess the Bank’s requirements, intending tenderers are advised to perform a site visit at their own cost on or before the last date of submission of tender during office hours (preferably from 10:00 Hrs to 17:00 Hrs) on the Bank’s working day (Monday-Friday).
vi. Kindly throw some light on termination and penalty clause. Kindly refer to clauses 1 (2), 1(3), 1(4), 1(5) and 1(7) of “Scope of Work and Schedule of Quantities” (Page No. 41 and 42) for Penalty related provisions.

Further, refer to clause 1(2) of “Scope of Work and Schedule of Quantities” (Page No. 41) and Clauses 2 and 32 of “Terms & Conditions of Contract” (Page No. 54 and 59) for termination related provisions.
vii. Whether MSME bidders or bidders registered with the NSIC are exempted from remitting EMD? No.
viii. Is it required for the client certificate to be submitted strictly in the format specified by the Bank? The client certificate submitted by the contractor should have all the parameters as indicated by the Bank in its specified format. In case any of the parameter indicated in the Bank’s specified format is not covered in the client certificate, the same will not be acceptable.

Further, Client certificate should be on letter head of the Client with signature of Authorized person. In case of Govt./Semi-Govt., organisations or a PSU, Client certificates should necessarily be signed by an official of the rank of Executive Engineer or equivalent. Client's report issued by private organization shall be accompanied by TDS Certificates.
ix. Is it required for Solvency certificate to be strictly in the format specified by the Bank? Solvency certificate should preferably be submitted in the format prescribed by the Bank.

However, solvency certificate certifying the solvency of the contractor to carry out the work costing equal to or more than Rs. 175.40 Lakhs (the Estimated cost of the project) will be accepted provided it covers all the details as specified in the Bank’s prescribed format i.e., turnover of previous three years, Credit facility/Overdraft facility enjoyed by the firm and the period from which the firm has been customer of the bank.

In case solvency certificate does not cover turnover and credit/overdraft facility details, the same should be included in the covering letter for the solvency certificate (on letter head of the Bank) addressed to RBI.
x. Do we need to employ the housekeeping staff currently serving at RBI under the existing contract? How many female staff shall be required to be employed? There is no compulsion of employing the housekeeping staff currently serving at RBI under the existing contract.

For details of the manpower to be employed, kindly refer to clause 1 [B] of “Scope of Work and Schedule of Quantities” (Page No. 40).
xi. Will the uniform cost and cost towards PPE kits (in case of pandemic outbreak) be borne by the contractor? Yes, the contractor will bear the cost of liveries including uniforms, PPE kits etc. to be provided to the workers. Kindly refer to clause 1(7) of “Scope of Work and Schedule of Quantities” (Page No. 42) for details.
xii. Do we need to submit separate invoices for each premises? There is no need for providing separate invoices for different premises. However, it is advisable to provide separate attendance sheets of the workers for each premises.
xiii. Are there any criteria for minimum service charge to be quoted? How will the decision of least bidder be taken in case of a tie i.e., if two bidders quote similar service charge? Kindly refer to “Bid evaluation criteria” for details.
xiv. Kindly give details about waste segregation and disposal. Whether any transportation of garbage is required by the contractor? Kindly refer to clause 1(10) V.2 of “Scope of Work and Schedule of Quantities” (Page No. 52) for details.

It is further clarified that the Contractor will be responsible for liaising with NMC for timely collection of waste from the Bank’s premises. In case, due to any reasons, NMC is unable to collect the garbage, it will be the responsibility of the contractor to remove the garbage from the Bank’s premises (i.e., from Office buildings as well as colonies) at their own cost.
xv. In Interpretation clause (b) of the tender document, it is mentioned that “Contractor” shall mean Company, a company incorporated under company act, 1956 and having its registered office at Nagpur, Maharashtra and shall include its successors and assigns.

Kindly clarify, that is it necessary for a company to have its registered office at Nagpur to be eligible for participating in this tender process?
It is hereby clarified that it is not necessary for a company to have its registered office at Nagpur for participating in this tender. However, as per the Eligibility criteria, it is necessary to have a full-fledged service setup at Nagpur

In this connection, the following amendments/corrigenda in the Tender document is notified:

1. The wordings under clause (b) (in the case of Company) of The Interpretation Clause (page no. 35), shall be replaced by the following:

“Contractor” shall mean Company, a company incorporated under Companies Act, 2013 or under any previous company law and having its full-fledged service setup at Nagpur, Maharashtra and shall include its successors and assigns.

3. It was further clarified by the Bank that the “Fixed amount by the Bank monthly” for the work in price bid format of Part II Financial bid may be read as ₹11,46,525/-. A corrigendum in this regard has already been placed at MSTC portal. Tenderers were advised to quote their profit/service charge as a percentage of this fixed cost.

4. All the above points were noted and agreed by the firms. Firms were advised to adhere to the prequalification criteria and all terms & conditions mentioned in the tender documents.

Please note:
A This document (Minutes of the Pre-bid meeting cum Corrigendum) shall form a part of the tender. Hence, it shall be signed and submitted along with the tender by the tenderers.
B Rest of the terms and conditions and specifications as mentioned in the tender documents shall continue to remain the same.
C The above amendments/clarifications are issued for the information of all the intending bidders.
D The submission of bid by the firm shall be construed to be in conformity to the bid document and amendments/clarifications given above.
E In case any vendors have already uploaded their bids to the MSTC portal before issuance of this Minutes of the Pre-bid meeting cum Corrigendum, they are advised to revise their bids and re upload their bids to the MSTC portal.
